Procuring Cause
The North Shore Board of REALTORS
â conducts arbitration hearings for members who have disputes regarding the disposition of splitting commissions. Some reference this to procuring cause. Black's Law Dictionary, Fifth Edition, defines procuring cause as follows: The proximate cause; the cause originating a series of events which, without break in their continuity, result in the accomplishment of the prime object. The inducing cause; the direct or proximate cause. Substantially synonymous with "efficient cause."
"A broker will be regarded as the "procuring cause" of a sale, so as to be entitled to commission, if his efforts are the foundation on which the negotiations resulting in a sale are begun. A cause originating a series of events which, without break in their continuity, result in accomplishment of prime objective of the employment of the broker who is producing a purchaser ready, willing, and able to buy real estate on the owner's terms. Mohamed v. Robbins, 23 Ariz. App. 195, 531 p.2d 928, 930." (from the National Association of REALTORS
â Code of Ethics and Arbitration Manual.)The new policy of NAR beginning January 1, 1998 states that "successful transaction" is defined as "a sale that closes or a lease that is executed". A few members had heard that there is no procuring cause any more. That is not correct. There are no specific rules for procuring cause, however, a panel of your peers, after a hearing will make a determination of whom "gets the commission".

Exempt listings are listings taken by those Participants or their agents who are affiliated with the MLS. If the owner of the property does not wish their listing in the MLS, they must sign a statement outlining that they have been explained the benefits of MLS but decline to have the listing in MLS. The owners must sign this statement and a copy must be sent to us for our records. MLSNI Rules and Regulations state: "SECTION 1.3 EXEMPTED LISTINGS: If the seller refuses to permit the listing to be disseminated by the Service, the REALTOR
â may then take the listing ("office exclusive") and such listing shall be delivered to the Service upon request but not disseminated to the Shareholder Boards' MLS Participants or the Service. A separate certification signed by the Seller indicating that he does not desire the listing to be disseminated by the Shareholder Boards MLS or the Service shall be filed with the Service or the Shareholder Board’s MLS upon request. This does not obviate the requirement of the Listing Broker to cooperate with other brokers unless it is the decision of the Seller that it is not in his best interests."An exempt listing may be advertised and may have a sign in the yard. The Board does not have the right or authority to regulate your advertising. If someone calls the Board office and they give a specific address we may state whether the listing is exempt or not -- there can be no other information given. We are not allowed to answer such questions as "give me a list of all the exempt listings in Lake Forest".
The next area many ask is if the exempt listing must allow cooperation with other REALTORS
â . NAR policy states that all REALTORSâ have the right to assume another REALTORâ will cooperative with other REALTORSâ unless it is in the best interest of the client. It is the client only who will decide if their listing agent will cooperate or not. If an agent decides not to cooperate with others and they did not discuss this with the owner, the agent could be in violation of his agency duties. This would mean that the agent not only violated the code of ethics but the law of agency which could result in major penalties, lawsuits, loss of license, etc.Many members who take exempt listings assume that they do not need to cooperate and the other members who want to show the listing assume that you must cooperate. For your protection you may wish to consider changing your exempt form to include the statement that the owner wishes or does not wish you to cooperate with other REALTORS
â . This is not a policy of the Board or NAR. This is just a suggestion to protect you.Some in their zealousness of obtaining a new listing forgets that the listing is not a power of attorney. You are an agent carrying out the wishes of your principal.

Starting July, the National Association of REALTORS® will roll out a new national advertising campaign to promote the benefits of hiring a REALTOR® when buying or selling a home. This new Public Awareness Campaign was approved by the NAR Board of Directors last November and will run for three years beginning July 1998.
There are four ads that will run, involving a seller, a buyer, a first time home buyer, and the forth ad will involve commercial, property management and investment transactions. The slogan for the campaign is "You Have a Life, We Let Your Live It; Were Your REALTORS®, Real Estate Is Our Life." The stories the ads tell involve individual buyers and sellers doing their daily work, while at the same time their REALTOR® is working for them putting together their Real Estate transaction. A doctor is seeing patients while his REALTOR® is showing the house he is selling, a teacher is working with students while her REALTOR® is arranging for a home inspection, a paramedic is getting his ambulance stocked with supplies while his REALTOR® is searching realtor.com for listings to show him.
The forth ad shows a restaurant owner opening for the day while his REALTOR® is scouting out a larger location for the restaurant. A couple who owns a apartment building is attending their son’s soccer game while their REALTOR® is showing one of their apartments to a prospective tenant. An accountant is preparing a client’s tax return while his REALTOR® is meeting with an appraiser at his investment property.
All of the ads show the public that there are a lot of things REALTORS® do for their clients and customers while they are busy with their own jobs. The message is positive, the ads are very nice looking, and they have been running successfully for the past year in California. The response from the REALTORS® and the public in California has been positive. The public has come away with a better impression of what the REALTOR® does to complete a Real Estate transaction. The REALTORS® from California that I have talked to all say the ads have been a great thing for their business. California gents have paid $25.00 a year to set up and run the ads in their state this past year.
To run the advertising campaign nationally, NAR will be assessing each agent $15.00 per year for the years 1999, 2000, and 2001. The ads will run during the Today Show and Good Morning America and during the evening news on ABC and NBC. Ads will run during popular prime time shows like Wings, Law and Order, etc. The ads will also run on Cable Television on Nickelodeon and the Lifestyle Channels. There will be approximately 500 spots run in 1998 and 1225 spots run in 1999, 2000, and 2001. The venues and frequency of the television ads will reach 99% of the viewing public. In addition, print and Internet ads will be run. To measure the effectiveness of the ads a survey will be conducted before the ads start and each year there after. The success and continuation of the campaign will be determined by the level of increased awareness and image the public has of a REALTOR® each year during the campaign.

If Real Estate if Your Profession…Politics Is Your Business
By the time you read this, we’ll be coming down to the primary election wire. Because this year’s election results will have a profound effect on your business - check yourself on the following:
Registration: Are you registered to vote at your current address? If not, contact your township clerk or the clerk of your community. You must be registered.
Vote: March 17 is election day. Be sure you know your precinct’s poling place. You cannot vote at any other. Local papers usually publish a map. If not, check with your clerk or neighbor.
Absentee Ballot: If you may be out of town on election day, you can vote "absentee" in advance. Check with the clerk as to time and place.
"Politics Is Your Business".
Just consider some of the issues your legislators will be voting on in the coming year:Springfield: (1) Revisions to the Real Estate License law. (2) A procedure for landlords to evict illegal tenants.
Washington: (1) Revise RESPA. (2) Eliminate PMI when no longer needed. (3) Raise FHA and VA loan limits. Further tax revision on depreciation. (4) Flat Tax. This could be the big issue. A "flat" tax means everyone’s income is taxed at the same rate with no exceptions. Those who favor a "flatter" tax would provide for exceptions. Those usually considered necessary are charitable deductions and the mortgage interest deduction. On that note’

MLSNI Update
The Board of Directors of MLSNI decided to amend the Rules & Regulations regarding tax information and tax year. The most current tax information (amount and year) should be input for the listing at the time of listing input; by December 31st of each year, all active inventory would have to be updated to the most current information.
All Association Executives will be sent formats of the updated MLSNI Rules & Regulations.
It was decided that listings can be placed in more than one property type, but the listing can only be marked SOLD in one category and must be marked CANCELED in any other appearance of the listing.
System Updates:
Effective Thursday, February 5th, the entry of "Y" in the "Internet Listing" field will no longer be valid.
Moore Data will be converting the "Y" entry in this field on any active property type 1 & 2 listings to "A", which is currently the selection for inclusion on the Realtor.com and Cyberhomes.com Internet pages (the Office Internet path will override the Internet Listing path in the case of those Broker offices that only wish to have their listings placed on Realtor.com).
The RealNet service bit will be "X".
The tentative release date for the Telephone Directory Searches function has been moved to Tuesday, February 10th.

VILLAGE OF WILMETTE
The following letter was received at the Board Office from Timothy J. Frenzer, Corporation Counsel for the Village of Wilmette.
In June of 1996, the Village of Wilmette amended its Fair Housing Ordinance to require individuals showing property for rental or sale to provide prospective purchasers or lessees with a printed summary of the Village’s fair housing laws. Persons may provide this disclosure by using either their own printed materials or a brochure provided by the Village. The Department of Law is responsible for the enforcement of this ordinance. Violations are punishable by a fine of $100 to $750 for a first offense and $250 to $750 for a subsequent offense.
In order to aid real estate professionals affected by this law, the Village created an attractive brochure, "Welcome to Wilmette," which contains the required disclosure statement along with helpful information about the Village and its many resources and services. The Village provides the brochure free of charge. Sample brochures and a letter explaining the law and its importance were mailed to you in October of 1997.
The Village is grateful to those real estate professionals who have shown their commitment to fair housing by providing the required fair housing disclosure. Unfortunately, the Village continues to receive complaints of violations of this law. The Village intends to enforce compliance with the disclosure law, both through random checks of compliance and by responding to complaints of non-compliance.
Therefore, I would like to remind you, and ask you to remind your associates, of the Village’s fair housing disclosure requirement. Copies of the "Welcome to Wilmette" brochure may be obtained at the customer service counter in the lobby of the Village Hall. PC Access costs
Unfortunately, as has been the case since Regional's involvement with Moore Data, Moore Data is confused about what software costs for members of MLSNI. Folks, Moore will never get it right. Several NSBR agents have requested PC Access software from Moore Data and they get a fax with prices of $159.99 per agent copy. This is the price that the rest of Moore's customers pay. MSLNI in their wisdom has negotiated the costs per agent down via a site license agreement with Moore. The cost of PC Access both the agent and broker version is $35.00. Call MLSNI only for the software. DO NOT call Moore Data.
PC Access tips
Notice to all offices using the "Broker" version of PC Access. The NSBR has determined by testing that you can easily input all your agents on one PC and then copy the file to all other PC's in the office. The broker version can only be installed on ONE computer. That's bad enough in that if you have four computers, PC Access will cost you 4x$35.00 for a total of $140.00. But now you have to input each agent's name, MLS ID # and password. If you have 25 agents that's a lot of work. But… you can enter all the agents in one computer and then copy the file C:\pcawin\pcawin.agt to all the other computers in the C:\pcawin directory and you're done.
Now all agents can use any of the computers and they will get their name to print on reports if they desire.
CNS update
By now most people should have made changes to their MLS software so that they can get into the MLS with the new CNS phone numbers. Adding new phone numbers is easy if you use Viewpoint, Rterm or Landmark Connect. If, however, you are using the new and improved PC Access you must install the CNS update disk. You must also run the CNS update disk if you are using Landmark CMA Publisher. The CNS update disk copies some "script" files to your computer that both PC Access and CMA publisher need to function properly. Without the CNS update disk dated 11/10/97 you are out of luck.
After installing CNS update you still have to manually make some changes in both PC Access and Landmark CMA. The board has instructions for both pieces of software. Call and we can fax you the goods. Call MLSNI if you need the CNS update disk. Their phone number is 1(630) 955-0011.
Tips for setup of PC Access or Landmark products
The Baud rate has been causing some problems for agents. Depending on your equipment, the baud rate can make or brake a connection. If you are using an external modem, set the baud rate to 38,400 or less. If you have a newer, 3 years old or less computer, and internal modem rated at 28,800 baud or faster, then set the baud rate to 57,600. If your baud rate is too fast for your equipment, your computer won't even attempt to dial.
Flow Control should have both Xon/Xoff checked and Hardware checked. The new CNS phone numbers need the hardware checked. Before you didn't need hardware just Xon/Xoff. This controls printing of multiple listings. Without the right setup, you can only print maybe three listings and then your computer may screw up.
Keep your program Disks
I have to comment on something I feel very important. With the changes in phone numbers to CNS and a lot of offices buying new computers lately I see a recurring problem. Offices and agents have had to install or re-install Landmark, Viewpoint or PC Access. Out of about one dozen offices I visited only Re/max Villager and Village Green Realty could locate their old disks. Kudos to you both. The problem is that The North Shore Board NO longer has any software to give to offices and agents. All software must be ordered from MLSNI and then the disks are mailed to you. This takes time. What does an office do with three new computers and no MLS access for two to four weeks while they wait for software?
Please, everyone, after you install your MLS software, put the disks back in their envelope or box and keep it safe in a drawer where the manager or long time secretary can find it. This will make your life easier because you know that next Spring MLSNI will have a new change for you to make your lives more, ummm, interesting.
ELIZABETH HOWE 1997 HUMANITARIAN AWARD WINNER
This year’s winner is Elizabeth Howe from Wilmette. She has been active in her community and in fair housing issues since serving as a member of Wilmette’s City Council. Currently she serves as a member of Wilmette’s Housing Committee.
Elizabeth is with Koenig & Strey REALTORS®, and was a charter member of the CHRB (North Shore Community Housing Resource Board). This organization brought together REALTORS® and Community leaders for the purpose of establishing better communications between the communities the North Shore Board of REALTORS® serves and the REALTOR® Community.
As a member of the CHRB, Elizabeth spearheaded numerous projects and most recently undertook to find and place minorities in the organization’s Minority Recruitment Program.
As a member of the North Shore Board of REALTORS®, Elizabeth has Chaired the Fair Housing Committee and represented the Board at the Oak Park Conference when it was held in Michigan.
An enthusiastic supporter of the rights of all, we are proud to have awarded the 1997 Humanitarian Award to ELIZABETH HOWE.

The Power of a Smile

Our business success depends upon building relationships and closing transactions successfully. We further our commitment to these relationships through various forms of contact such as an e-mail correspondence, a short personal note or maybe a phone call. Our business is relationship selling. We all work with the same inventory...what's the reason customers and clients buy and sell using our services rather than those of our competitors? Whether on the phone or in person, a smile is essential to building loyalty. A smile is powerful, contagious and it makes the other person feel important and special. It is extremely important for all of us to realize with so much of our business not taking place face-to face...transactions seem to happen over a fax machine, phone or through the use of Internet services...that our attitudes, smiles and listening skills need to be "top notch" in order to maintain our relationships.
Communication is made up of 38% verbal ability, 7% in chosen vocabulary used and 55% in non-verbal behavior. At best, we can communicate without face-to-face contact at an effectiveness of 45%...and that's on our best day!! What about those days when we are pre-occupied by transactions that aren't coming together, home inspections that reveal horrendous defects or what about the "personal stuff" that happens during our day? We need to plan for those times when a smile doesn't immediately lend itself to our conversations. If we are proactive and plan for the less than perfect days, a smile may be more readily available and might be just the reason a new prospect wants to enlist our expertise to the home selling or home buying process.
There are areas in all of our lives that must be nurtured in order to provide that smile, better customer service and good communication. If we challenge ourselves to spend more time in some of these areas of our lives, we may be better equipped to tackle the situations that pop up all day long that make those beautiful smiles memories rather than realities. If you feel that you haven't given yourself time in these areas, try to create those opportunities. The "daily rituals" that need quality attention are: sleep, exercise, nutrition, family, spirituality, to-do lists, travel, telephone, office, creative time, home and time alone. As you review this extensive list, the individual who can begin to spend quality time in these arenas can many times successfully manage the daily situations better and provide consistent smiles to customers, clients and significant others. It's a win-win for everyone.
