Soliciting listings
It has been the practice of numerous members of the North Shore Board to resubmit their listings to MLS so that the listing may once again come up as new or to give a new listing number with the New Year. MLSNI new charges a fee of $4.15 each time you resubmit the listing (or 50 cents if you provide the photo). If you insist on this practice you should note the old listing as withdrawn and not cancelled.
In MLSNI, withdrawn means that the listing company still has a valid listing, however the information has been withdrawn from MLS. Cancelled means the listing has been taken out of the service and the listing company no longer has a listing agreement.
A few members contacted the Board regarding to soliciting their listings, which were in the middle of being taken off from one listing number and resubmitted with a new number. These members felt that since it was the practice of many members in North Shore to continually resubmit listings that it should be the obligation of the soliciting agent to first run a second search of off markets to assure the listing has not been resubmitted.
Correspondence from NAR on this subject: "Participants in a multiple listing service should be able to rely on information provided by other participants. Consequently, if a listing broker indicates that a listing has been "cancelled", it would be reasonable for other participants to assume that the seller is no longer subject to an exclusive agreement with that broker. It would not be unethical for another participant to then contact a seller whose listing has been shown as "cancelled" to ascertain whether that seller would be interested in entering into a listing agreement with him. The same would not necessarily hold true for listings shown as "withdrawn". A listing may be taken off the market while the seller remains subject to an ongoing exclusive agreement."
To avoid you valid listings from being solicited, you must use withdrawn to resubmit listings.

Dear Members:
You probably do not want to hear this but, I have had the opportunity recently to spend a week in sunny Florida. The weather was perfect with the only exception being that it was in the 50's in Chicago while I was enjoying the 80's in Florida. Even the weathermen were upset about that, as they usually like to point out the difference in temperature between Florida and Chicago. As I always do wherever I go, I picked up the Real Estate Section of the local paper on Sunday to see what was going on in the marketplace. Reading the Real Estate Section for the area reminded me of how fortunate we are on the North Shore.
The article on new building permits listed thirty new permits for the past week and only one home was valued over $400,000.00, two from $300,000.00-$400,000.00, one between $200,000.00 and $300,000.00, five between $100,000.00 and $200,000.00, and Twenty-one homes being started under $100,000.00. The average was $119,500.00
Closed sales of existing homes for the same week ranged from $81,000.00 to $1,700,000.00 with the average being $195,000.00. Condominiums averaged $209,500.00. Quite a switch from our marketplace. While we think of Florida as a place to vacation or retire to when we have some money, the Realtors down there see it as a marketplace of condominiums, time shares, and a marketplace where out of town buyers make up a large percentage of the clientele.
In a market like ours where the average sale price of a single family home is $389,830 and the average price for a condominium is $178,046 we have a much easier job. Most of our clients and customers are from the area and therefore are more familiar with the marketplace. For the most part our clients are not looking at homes as something to do on a cloudy day of their vacation.
The weather right now may be cold, snowy, and raw, but I'll take the North Shore market over just about anywhere else in the country. So the next time your thinking that things are going a little slow, think of your poor unfortunate colleagues in Florida who are working twice as hard to make the volume of sales we enjoy. They may have the sun, the beach, and warm weather, but we have one of the best market places in the country.
The next time things are slow, visit sunny Florida, rest, relax, and recharge; then come home put on your snow boots and sell, sell, SELL ! ! !
AGENCY REDEFINES CONSUMER SERVICE DIVISION
Commissioner Jack Schaffer is pleased to announce several changes in the Agency's Consumer Division. The new Consumer Service Division, headed by Thomas R. Schober, has centralized Consumer Services to handle complaints and inquiries for Bureau of Banks and Trust, Bureau of Residential Finance and Bureau of Real Estate Professions.
Mr. Schober who brings with him the vast experience of management and technical skills has implemented new procedures and policies to expedite consumer concerns and correspondence. Under Schober's direction, the Agency's Consumer Service Coordinators are being cross-trained in each category of License to accommodate the demands of the Industry and Public.
Cheryl Brown is now currently coordinating complaints for the Real Estate Professions. Ms. Brown works for the Consumer Services Division in Chicago. Complaints against Real Estate licensees have been centralized in our Chicago office and are directed to Cheryl Brown. In turn, all complaints are presented to the Complaint Review Committee and Eli Sidwell, the Director of Real Estate, on a monthly basis. Jewel M. Starnes, who brings with her 19 years of governmental experience is currently coordinating the Commercial Banking Division and Savings Banks consumer support. Jewel can be reached at (312) 793-7068 for further information.
Virginia Calvin, an 8-year veteran of State Government combines experiences with the Agency's Savings Bank Supervision and the Mortgage Banking area. Virginia handles all the initial contacts for the Mortgage Banking section. Virginia can be reached at (312) 793-1457 for any inquiries relating to Mortgage Banking.
In keeping with Commissioner Schaffer's focus on efficiency and service, the Consumer Service Division will assist consumers under our jurisdictional authority or will refer them to another agency or regulatory body.
BROKER ROSTER MAILED
Now that the Salesperson renewal is completed, the Office of Banks and Real Estate will send to each managing broker and broker firm a roster of all salesperson licensees shown as sponsored by the managing broker or broker firm. Along with the roster reports will be an instruction sheet explaining what each broker should do in verifying the salespersons under their direction.
Basically, if OBRE's records match with the managing broker records, nothing needs to be done. If there are discrepancies, then the managing broker will be given directions on correcting the problem.

What are the provisions in the amendments to the Seller Disclosure law, and when do they take effect?
House Bill 358, amending the Residential Real Property Disclosure Act (the Act), was approved (P.A. 90-383) by Governor Edgar on August 15, 1997, and it will take effect on January 1, 1998. The amendments can be summarized as follows:

Another amendment, set forth in Section 30, now makes it the seller’s specific duty to supplement the disclosure in written form if the seller gains actual knowledge of a material defect after the original disclosure form was delivered to a prospective buyer. No particular form for supplemental disclosure is required so long as it is in writing.

A statement has been added to Section 40 of the Act saying that if a seller discloses a meterial defect in a supplement to the original disclosure form, the buyer has no right to terminate the contract. The only exception to this rule is where the seller completes a supplement to the original disclosure form. In other words, if the seller was not completely honest when he filled our the first form, and then had a change of heart, indicating a material defect in a supplemental form, the buyer may still have the right to rescind the contract.

A statement has been added to the statutory disclosure form which reads as follows: Note: These disclosures are intended to reflect the current condition of the premises and do not include previous problems, if any, that the seller reasonably believes have been corrected.

Section 55 gives the buyer the right to terminate the contract if the seller refuses or fails to provide the disclosure document prior to the conveyance of the residential real property.

Compuserve CNS phone access
By now, everyone should have received something about the new access numbers for the MLS Compass system. You will get an "update" disk from MLSNI with a new script for access to the MLS using Viewpoint, Landmark™ Connect & CMA, and PC Access. Just run the disk and it's install program and that should do it.

These phone numbers should improve your access. All you need is the one phone number nearest your house and that's it. IF, you get a busy signal, CNS will automatically re-route your call to an open line. No more busy signals. (in theory). Speed of this service is 33.6 and should be 56K before too long.
Our cut over is scheduled the week of Christmas and Chanukah. The old phone numbers will still work until January 19 when Lake Forest, Northbrook and Skokie lines are scheduled to be removed. So don't dilly-dally. Make the change to the new numbers.

PC Access users will need a new "script" which will be sent to you from Moore Data via a disk. The disk will also set up Landmark™ CMA Publisher and Landmark™ Database.
Classes on your Time
That's right, if you want a computer class taught on YOUR terms, do this. Get together five to ten friends and call me. I will set up a class time based on your schedule. We have had good luck with this at the board. You name the subject or program and I'll meet you in the computer room and hopefully everyone will learn something.
New Computer store
There's a new place to buy computers and stuff. On the North East corner of Lake/Cook and Skokie Blvd. (just North of the Lincoln Mercury dealer) Comp USA just opened last month. It's a good store with lots of hardware and software. There prices are much better than computer City all though now they seem more eager to match the prices at Comp USA. I personally would try Comp USA first, I think you'll get better service.

Criss Cross telephone directory search
January 12 is the tentative date that the MLS will offer a searchable "criss cross" style directory. You can then search by a telephone number or a person's name and get the information you seek. Should be a great tool.
Lockbox Agreement Does Not Exculpate Broker from Liability.
A decision from the Court of Appeals of Maryland held that a lockbox agreement did not protect a brokerage from liability for its own negligence. Adloo v. H.T. Brown Real Estate, Inc., 344 Md. 254, 686 A.2d 298 (1996). The Adloos had entered into an exclusive listing agreement for the sale of their home with H.T. Brown Real Estate, Inc. (the "Broker"). This agreement contained a clause stating that neither the Broker, his agents or subagents "are responsible for vandalism, theft or damage of any nature whatsoever to the property." In addition, the Adloos executed a lockbox authorization, which included this provision: "Seller further acknowledges that neither Listing or Selling Broker nor their agents are an insurer against the loss of personal property; Seller agrees to waive and releases Broker and his agents and/or cooperating agents and brokers from any responsibility therefor."
A man identifying himself as a salesperson with another brokerage called the Broker’s office saying he wanted to show the Adloos’ home and requesting the lockbox combination. The Broker’s office had a policy of verifying a licensee’s identity before divulging this information. However, in this case, without conducting any independent investigation to verify the caller’s identity, the Broker’s office attempted to verify his identity only by calling him back at the phone number he had provided, and gave him the combination. The caller was an impostor and was not a licensee. Cash, jewelry and other items totaling $40,000 were stolen from the home.
The Adloos filed and settled a claim with their insurance carrier and then sued the Broker for damages. The trial court awarded them $20,000. On appeal to the Court of Special Appeals, characterizing the lockbox authorization provision as an exculpatory clause, the court found it valid and enforceable and reversed the trial court. On appeal to the Court of Appeals, the issue was whether the language in the lockbox agreement was enough to exculpate the Broker from liability resulting from its own negligence. The court stated the general rule, that contracts will not be interpreted to indemnify a party against his own negligence unless an intention to do so clearly is expressed, and found that the lockbox agreement did not meet this test. "Because it does not clearly, unequivocally, specifically and unmistakably express the parties’ intention to exculpate the [Broker] from liability resulting from its own negligence, the clause is insufficient for that purpose." Moreover, the court found the same defect in the listing agreement clause regarding theft, and it reinstated the trial court’s judgment in favor of the Adloos. ATTENTION REALTORS® INVOLVED WITH CONDOS AND TOWNHOMES
The Association of Condominiums, Townhouse and Homeowners Associations (ACTHA) will sponsor an all-day conference with a special session of interest to REALTORS® on Saturday, February 28, 1998, at the Midland Hotel, located at 172 W. Adams in downtown Chicago.
This seminar from 9:00 a.m. - 10:30 a.m. is "Up for Sale: Association Obligations." Issues that will be covered are when to request association documents, right of first refusal, association and property disclosures, how to avoid financing obstacles and what to do about existing architectural violations. Since these issues have legal ramifications for buyers and sellers, the seminar is designed to provide relevant information to real estate brokers.
Seminar speakers are John O’Brien and Terry Dixon. Mr. O’Brien, a real estate attorney, is a member of the REALTOR®/Lawyer Committee of the Northwest Association of REALTORS® and will provide the legal aspect. Ms. Dixon of McGill Management will cover the subject from the perspective of the association and management.
ACTHA is offering a special price for REALTORS® attending the conference. Registration is $15.00 for the morning session only; or $45.00 for the full day (which includes lunch). To receive the reduced rate, your real estate license must be presented at the door.
